1. Acceptance of Terms

Welcome to EvoloGuard, a smart security management platform provided by Evolo Systems Pvt. Ltd. ("Company," "we," "our," or "us"). By accessing or using EvoloGuard (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

EvoloGuard is a digital security and visitor management platform designed for gated communities, residential societies, and commercial complexes. The Service includes:

• Digital gatepass generation (QR/OTP)
• Visitor and vehicle management
• Daily help tracking and staff management
• Smart noticeboard and announcements
• Helpdesk and complaint management
• Guard patrol tracking
• Entry/exit logs and analytics

3. User Accounts and Registration

3.1 Account Creation

To use EvoloGuard, you must register and create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 User Types

• Residents: Individuals living in registered communities
• Guards: Security personnel managing gate operations
• Admins: Society management with administrative privileges

4. Free Trial and Subscription

4.1 Free Trial Period

New users are eligible for a 3-month free trial with full feature access. No credit card is required to start the trial. The trial can be cancelled at any time without charges.

4.2 Paid Subscription

After the trial period, continued use of the Service requires a paid subscription. Pricing details will be communicated before the trial ends. You may choose to subscribe or discontinue the Service.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period. No refunds will be provided for partial periods.

5. User Conduct and Responsibilities

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Transmit any harmful code, viruses, or malicious software
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Impersonate another person or entity
• Collect or store personal data of other users without consent
• Use the Service to harass, abuse, or harm others

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

We implement security measures to protect your data, but we cannot guarantee absolute security. You acknowledge that you provide information at your own risk.

7. Intellectual Property Rights

7.1 Ownership

The Service, including all content, features, functionality, software, and design, is owned by Evolo Systems Pvt. Ltd. and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. This license does not include any right to resell, reproduce, distribute, or create derivative works.

8. Service Availability and Support

8.1 Service Availability

We strive to provide uninterrupted Service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 Customer Support

We provide 24/7 customer support via email, phone, and in-app chat. Support response times may vary based on the nature and urgency of the issue.

9. Training and Onboarding

We provide comprehensive training for guards, residents, and administrators during the onboarding process. Training materials, guides, and reference documents are available in local languages upon request.

10. Limitation of Liability

To the maximum extent permitted by law, Evolo Systems Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Evolo Systems Pvt. Ltd., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, subject to our data retention obligations.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
